Dismissal without legal basis: the amparo court must supplement deficient arguments

Supplementing deficient complaints (suplencia de la queja). It applies when the underlying proceeding is dismissed in disregard of the applicable legal framework.

Official heading (Spanish): SUPLENCIA DE LA QUEJA DEFICIENTE. PROCEDE CUANDO SE SOBRESEE EN EL JUICIO DE ORIGEN INOBSERVANDO EL MARCO JURÍDICO APLICABLE.

The ruling

In several cases, courts dismissed proceedings on inadmissibility grounds that did not fit the legal framework. Hearing the resulting direct amparos and one appeal, the Collegiate Circuit Court held in binding precedent that the court must supplement deficient arguments when the underlying dismissal disregarded the applicable law.

Our take

An unjustified dismissal deprives a party of a ruling on the merits, and this precedent treats it as a violation the amparo court must correct even if the arguments raised are imperfect. For companies litigating before the TFJA or state courts, it is a safety net. It does not replace a well-drafted complaint, but it reduces the risk of losing a case because the challenge to the dismissal was poorly framed. We recommend citing it expressly in the amparo complaint to steer the court toward supplementing.

What to do

  • Cite this binding precedent in every amparo against a dismissal.
  • Identify precisely which rule the authority ignored in dismissing.
  • Do not rely on supplementing: address every ground of the dismissal.
