Amparo against statutes: applying authorities cannot defend the law
Review appeal in indirect amparo against general rules. The local judicial administration body, as executing authority, lacks standing to file it when its grievances, although framed against the effects of the protective ruling, in essence challenge the constitutional analysis of the contested rule (article 87 of the Amparo Law).
Official heading (Spanish): REVISIÓN EN AMPARO INDIRECTO CONTRA NORMAS GENERALES. EL ÓRGANO DE ADMINISTRACIÓN JUDICIAL LOCAL, COMO AUTORIDAD EJECUTORA, CARECE DE LEGITIMACIÓN PARA INTERPONERLA CUANDO SUS AGRAVIOS, AUNQUE SE FORMULEN CONTRA LOS EFECTOS DEL FALLO PROTECTOR, COMBATEN EN ESENCIA EL ESTUDIO DE CONSTITUCIONALIDAD DE LA NORMA RECLAMADA (ARTÍCULO 87 DE LA LEY DE AMPARO).
The ruling
Several District Courts granted amparo against an amendment to the Organic Law of the Chihuahua Judiciary and bound the local Judicial Administration Body, which had been sued only for applying it. That body appealed, defending the decree’s constitutionality. Relying on article 87 of the Amparo Law, the Collegiate Circuit Court dismissed the appeal for lack of standing.
Our take
The case is not about tax, but the rule matters for tax litigation. In amparo against tax provisions, the SAT often appears as the applying authority and sometimes appeals by defending the statute. Under this precedent, those grievances should not be reviewed when relief rested on the rule’s unconstitutionality; only grievances against the effects binding the applying authority count. It is binding precedent (jurisprudencia) of a Collegiate Circuit Court, mandatory within its circuit and persuasive elsewhere. Complainants should raise it in an adhesive review or in their pleadings.
What to do
- In amparo against tax statutes, check who files the review appeal and what its grievances actually attack.
- Seek dismissal of the appeal when the applying authority only defends the rule’s constitutionality.
- In the complaint, separate defects of the application act from defects of the rule itself.
