Mexico City property tax: the occupancy return can be challenged in amparo
Legal standing in indirect amparo. Property-tax payers whose properties have a cadastral value within brackets L, M, N, O and P of the schedule in article 130, section I, of the Mexico City Tax Code have standing to challenge article 132, last paragraph, of that Code and the general rules issuing the guidelines for the related informative return.
Official heading (Spanish): INTERÉS JURÍDICO EN AMPARO INDIRECTO. LO TIENEN LAS PERSONAS OBLIGADAS AL PAGO DEL IMPUESTO PREDIAL RESPECTO DE INMUEBLES CUYO VALOR CATASTRAL SE UBICA EN ALGUNO DE LOS RANGOS L, M, N, O Y P DE LA TARIFA PREVISTA EN EL ARTÍCULO 130, FRACCIÓN I, DEL CÓDIGO FISCAL DE LA CIUDAD DE MÉXICO, PARA RECLAMAR EL DIVERSO 132, ÚLTIMO PÁRRAFO, DEL PROPIO ORDENAMIENTO Y LAS REGLAS DE CARÁCTER GENERAL POR LAS QUE SE EXPIDIERON LOS LINEAMIENTOS PARA LA PRESENTACIÓN DE LA DECLARACIÓN INFORMATIVA RELATIVA.
The ruling
Since 2025, the Mexico City Tax Code has required property-tax payers in brackets L, M, N, O and P to file, by June 30 each year, a return on the occupancy of their residential properties. A Regional Plenary Court held that the duty is not optional and that those subject to it have standing to challenge it through indirect amparo.
Our take
The ruling closes a convenient escape: treating a duty as optional and thereby keeping it out of court. The Regional Plenary Court treats it for what it is, an obligation to act that binds taxpayers from the day the rule took effect. It affects individuals and companies holding high-value residential property in Mexico City. One caveat: the ruling addresses standing, not the merits. Anyone considering a challenge must watch the deadline, which for self-executing rules runs from entry into force or from the first act of application.
What to do
- Identify Mexico City residential properties in property-tax brackets L to P.
- Check for a recent act of application that keeps an amparo challenge within the filing deadline.
