Amending an amparo complaint: the clock starts once the full basis is known
Amendment of the amparo complaint. The period to file it on new grounds begins when the complainant has reliable, complete and actual knowledge of the legal basis and reasoning of the challenged act, not upon service of the order acknowledging receipt of the authority's report [binding precedent P./J. 8/2018 (10a.) does not apply].
Official heading (Spanish): AMPLIACIÓN DE LA DEMANDA DE AMPARO. EL PLAZO PARA PRESENTARLA POR CONCEPTOS DE VIOLACIÓN INICIA CUANDO EL QUEJOSO TIENE CONOCIMIENTO FEHACIENTE, COMPLETO Y MATERIAL DE LA FUNDAMENTACIÓN Y MOTIVACIÓN DEL ACTO RECLAMADO, Y NO CON LA NOTIFICACIÓN DEL ACUERDO QUE TIENE POR RECIBIDO EL INFORME JUSTIFICADO [INAPLICABILIDAD DE LA JURISPRUDENCIA P./J. 8/2018 (10a.)].
The ruling
In an amparo against an arrest warrant, the judge later ordered production of the audio and video records supporting the act. Once received, the complainant amended the complaint, and the judge rejected it as untimely. The Collegiate Circuit Court held that the period under article 17 of the Amparo Law runs from full knowledge of those records, not from the order acknowledging the authority's report.
Our take
Although it arose in a criminal case, the rule works in any amparo: if the authority does not file with its report the documents supporting the act, the period to amend does not start. In tax and administrative matters, reports often refer to files or exhibits that are never produced. Request those records expressly and keep a record of the date you actually see them. This is an isolated precedent and P./J. 8/2018 (10a.) remains the general rule, so do not rely on it if you can still amend on time.
What to do
- If the authority's report omits the supporting records, ask the judge to order their production.
- Record the date you obtain full access to those records.
- File the amendment promptly rather than using up the full period.
