An injunction takes effect when the judge e-signs it, not when it is served
Suspension in amparo proceedings. It takes effect from the moment the head of the court authorizes the relevant order using a certified electronic signature, with cryptographic evidence of the exact date and time of issuance.
Official heading (Spanish): SUSPENSIÓN EN EL JUICIO DE AMPARO. SURTE EFECTOS DESDE QUE LA PERSONA TITULAR DEL ÓRGANO JURISDICCIONAL AUTORIZA EL ACUERDO RELATIVO A TRAVÉS DEL USO DE FIRMA ELECTRÓNICA CERTIFICADA CON LA EVIDENCIA CRIPTOGRÁFICA RELATIVA A LA FECHA Y HORA EXACTAS DE SU EMISIÓN.
The ruling
A party was granted a provisional suspension against an order to return land in a criminal case, but the act was carried out hours earlier, on the same day the judge e-signed the order. The Collegiate Circuit Court held that, under article 136 of the Amparo Law and General Agreement 12/2020, the suspension takes effect from the electronic signature, regardless of when it is served.
Our take
The cryptographic evidence of the electronic signature becomes the clock that determines whether an act occurred before or after the suspension. For the petitioner, every hour counts, and this ruling provides certainty on the exact moment protection begins. For authorities and opposing parties carrying out the act, the lesson is the reverse: acting after the signature, even before service, may amount to non-compliance. In this case, the act was carried out before the signature, so the protection did not reach it. Notify the authority immediately.
What to do
- Download the cryptographic evidence of the suspension order as soon as it is available.
- Inform the executing authority of the order at once, without waiting for formal service.
- If the act is carried out, compare its timing with the signature to support non-compliance.
