Amparo compliance: prompt payment also sets the cut-off for periodic benefits

Compliance with amparo judgments. Payment within a short period is a parameter for setting the date up to which periodic monetary benefits must be calculated.

Official heading (Spanish): CUMPLIMIENTO DE SENTENCIAS DE AMPARO. EL PAGO EN UN PLAZO BREVE CONSTITUYE UN PARÁMETRO PARA DEFINIR LA FECHA HASTA LA CUAL SE DEBEN CALCULAR PRESTACIONES ECONÓMICAS PERIÓDICAS.

The ruling

In the same case on compliance with an amparo ordering periodic benefit payments, the Collegiate Circuit Court held that payment within a short period is another parameter for defining the date up to which those benefits must be computed.

Our take

This ruling complements the one on significant payments: besides how much is paid, timing matters. Prompt payment allows the calculation to close without the debt growing while incidents are pending. In the court's logic, speed is an incentive for the obligor and a protection for the beneficiary, who does not wait years for an amount that keeps being updated. The ruling does not say how many days count as a 'short period'; that is left to the judge in each case. For the obligor, we recommend paying the undisputed amount without waiting for the debate on the exact figure to end.

What to do

  • Pay the undisputed portion once the judgment is final, without waiting for the final calculation.
  • Record the date of each step to prove the payment was prompt.
  • As beneficiary, point out delays that justify extending the cut-off date.
