Biometric CURP: courts may grant a provisional stay in amparo
Provisional suspension in indirect amparo. It is available against article 91 Bis of the General Population Law, which provides for the creation of the biometric Unique Population Registry Code (CURP).
Official heading (Spanish): SUSPENSIÓN PROVISIONAL EN AMPARO INDIRECTO. PROCEDE CONTRA EL ARTÍCULO 91 BIS DE LA LEY GENERAL DE POBLACIÓN QUE PREVÉ LA CREACIÓN DE LA CLAVE ÚNICA DE REGISTRO DE POBLACIÓN (CURP) BIOMÉTRICA.
The ruling
An individual challenged article 91 Bis of the General Population Law, which creates the biometric CURP and a Single Identity Platform, through indirect amparo. The district judge granted a provisional stay and the authority appealed. The Collegiate Circuit Court upheld the stay: it does not harm public order or social interest, and it shields privacy from potentially irreversible harm.
Our take
The court weighs privacy and digital sovereignty against the search for missing persons and finds that a stay does not paralyze the State. For individuals, this opens a door. For companies, it signals where judicial scrutiny of biometric data is heading: if courts demand balance from the government, expect similar rigor toward employers collecting fingerprints or facial scans. The caveat: this is an isolated precedent issued on appeal of a provisional measure, and it says nothing final on the provision's constitutionality.
What to do
- Map which biometric data the company collects, on what legal basis and under which security measures.
- Assess with interested executives or shareholders whether to file an amparo and request a stay.
- Review privacy notices and internal policies against the proportionality standard the court applies.
