Online amparo filings: one second past midnight is already late
Electronic filings due on the last day in amparo. They are timely when, according to the records generated by the Federal Judiciary's Online Services Portal, they are logged within the time limit set by article 21, second paragraph, of the Amparo Law.
Official heading (Spanish): PROMOCIONES ELECTRÓNICAS DE TÉRMINO EN EL AMPARO. SON OPORTUNAS CUANDO, CONFORME A LOS REGISTROS GENERADOS POR EL PORTAL DE SERVICIOS EN LÍNEA DEL PODER JUDICIAL DE LA FEDERACIÓN, QUEDEN DOCUMENTADAS DENTRO DEL LÍMITE TEMPORAL PREVISTO EN EL ARTÍCULO 21, PÁRRAFO SEGUNDO, DE LA LEY DE AMPARO.
The ruling
Collegiate Circuit Courts disagreed over appeals sent through the Federal Judiciary's Online Services Portal seconds or minutes after midnight on the last day. The Regional Plenary Court held that timeliness is measured by the Portal's objective records against the limit in article 21, second paragraph, of the Amparo Law: if the filing is logged afterwards, it is late, however small the gap.
Our take
There is no grace period. The Regional Plenary Court rejects the idea that system processing time or the right of access to justice can justify accepting filings logged at 00:00:01. For any company litigating amparos, this means changing habits: filing in the last minute puts the whole case at stake. We recommend internal deadlines at least one day ahead for filings due on a given date. The ruling preserves the mechanisms expressly provided for system failures, so document any technical incident as it happens.
What to do
- Set the business day before the deadline as the internal cut-off for online filings.
- Keep the Portal receipt showing the date and time of every submission.
- Document any system failure immediately with screenshots and reports to use the available mechanisms.
