No interim suspension against a UIF blocked-persons listing

Provisional suspension in indirect amparo. It is not available against inclusion in the list of blocked persons issued by the Financial Intelligence Unit of the Ministry of Finance (article 129, section XIV, of the Amparo Law in force as of October 17, 2025).

Official heading (Spanish): SUSPENSIÓN PROVISIONAL EN AMPARO INDIRECTO. ES IMPROCEDENTE CONTRA LA INCLUSIÓN EN LA LISTA DE PERSONAS BLOQUEADAS QUE EMITE LA UNIDAD DE INTELIGENCIA FINANCIERA DE LA SECRETARÍA DE HACIENDA Y CRÉDITO PÚBLICO (ARTÍCULO 129, FRACCIÓN XIV, DE LA LEY DE AMPARO VIGENTE A PARTIR DEL 17 DE OCTUBRE DE 2025).

The ruling

A company placed on the Financial Intelligence Unit (UIF) blocked-persons list sought an interim suspension in an indirect amparo and was denied. The Collegiate Circuit Court upheld the denial: where the complaint itself shows the block stems from article 115 of the Credit Institutions Law, article 129, section XIV, of the amended Amparo Law bars the measure.

Our take

After the October 2025 amendments to the Amparo Law, the fast track to regain access to frozen accounts is gone. The court does not require any showing of wrongdoing: it is enough that the block comes from the UIF. For an operating business this can mean weeks or months without cash flow while the merits are decided. In our view, the defense now shifts to the hearing procedure before the UIF itself and to the merits of the amparo. The weak spot is that the ruling treats a listing as sufficient evidence of illegality, which sits uneasily with the presumption of innocence.

What to do

  • Maintain a backup liquidity plan if the company relies on a single bank.
  • If blocked, immediately request a hearing before the UIF and document the lawful source of funds.
  • Frame the amparo around the merits of the block rather than relying on a suspension.
