Guanajuato: an annulled traffic fine already paid must be refunded with interest
Traffic fine in the State of Guanajuato. Once annulled, it gives rise to payment of interest under article 53, second paragraph, of the Municipal Finance Law of that state.
Official heading (Spanish): MULTA POR INFRACCIÓN DE TRÁNSITO EN EL ESTADO DE GUANAJUATO. DECLARADA SU NULIDAD, GENERA EL PAGO DE INTERESES EN TÉRMINOS DEL ARTÍCULO 53, PÁRRAFO SEGUNDO, DE LA LEY DE HACIENDA PARA LOS MUNICIPIOS DE DICHA ENTIDAD FEDERATIVA.
The ruling
Two Collegiate Circuit Courts disagreed on whether payment of a municipal traffic fine later annulled counts as an undue payment generating interest under article 53, second paragraph, of the Guanajuato Municipal Finance Law. The Regional Plenary Court held that it does: interest accrues from the payment date until the refund.
Our take
This is a local ruling of modest amounts, but its logic is useful. A fine paid and later annulled is treated as an undue payment, with interest from the payment date. For companies with vehicle fleets in Guanajuato, it changes the math on challenging fines already paid: beyond the principal, the financial cost is recovered. The reasoning may extend to other municipal charges under similar rules, though each finance law must be checked. In our experience, the practical issue is not the right itself but that nobody follows up on the refund after winning.
What to do
- Keep a log of fines paid in Guanajuato that could be challenged.
- After annulment, request a refund with interest from the payment date.
- Assign someone to follow up on municipal refunds until collected.
