Conagua: without prior alert, water-mailbox service is unlawful
Electronic service through the water mailbox (buzón del agua). When the authority does not prove it sent the electronic alert to the party before serving by that means, as a general rule the service is unlawful.
Official heading (Spanish): NOTIFICACIÓN ELECTRÓNICA POR BUZÓN DEL AGUA. CUANDO LA AUTORIDAD NO ACREDITA EL ENVÍO DEL AVISO ELECTRÓNICO AL PARTICULAR, PREVIO A LA NOTIFICACIÓN POR ESE MEDIO, POR REGLA GENERAL, SE ACTUALIZA UN VICIO QUE PROVOCA SU ILEGALIDAD.
The ruling
A rural production company challenged before the TFJA Conagua's refusal to extend its water concession, served through the water mailbox without a prior alert. The Regional Chamber dismissed the case. The Collegiate Circuit Court held that service has two stages, deposit and alert, and without the alert the four-business-day deemed-service period does not start.
Our take
The reasoning can be extended to other electronic mailboxes, starting with the tax mailbox: if the authority undertook to send an alert, its absence prevents charging the taxpayer with the consequences of not checking the mailbox. It affects companies holding water concessions or permits, especially industrial and agricultural users. We read it favorably, but it is an isolated precedent with a caveat: if the party opened the document on time, the defect may not invalidate service. The authority bears the burden of proving the alert; demand that proof from the initial complaint.
What to do
- Keep the email and phone registered with Conagua current and check the water mailbox regularly.
- In every challenge, require the authority to produce proof of the prior electronic alert.
