Stalled labor award: the amparo judge can order enforcement to move forward
Provisional suspension with restorative effects. It may be granted against omissions and delays in the enforcement stage of a labor award, even if not on the terms requested but on those appropriate to the available information.
Official heading (Spanish): SUSPENSIÓN PROVISIONAL CON EFECTOS RESTITUTORIOS. PUEDE CONCEDERSE ANTE OMISIONES Y DILACIONES EN LA FASE DE EJECUCIÓN DEL LAUDO, AUN CUANDO NO SEA EN LOS TÉRMINOS SOLICITADOS, SINO EN LOS IDÓNEOS A PARTIR DE LOS DATOS DISPONIBLES.
The ruling
After a final labor award ordered reinstatement and payment of benefits, the labor board stopped acting. In an indirect amparo, the worker sought a suspension ordering enforcement; the District Court denied it because omissions were at stake. The Collegiate Circuit Court held that a suspension with restorative effects is available, though not necessarily on the terms requested, and that the judge must set its scope with the information at hand.
Our take
For an employer facing an award, the message is plain: inactivity by the labor authority is no longer a guaranteed breather. The worker can obtain, at the provisional suspension stage, an order to move the file forward without waiting for the amparo judgment. The nuance is that the judge does not simply grant what was asked; the effects are tailored to what the record shows. In our experience, old awards ordering reinstatement carry liabilities that keep growing. Assess them now and negotiate on updated figures, before a suspension speeds up payment demands and attachments.
What to do
- List final awards pending enforcement and quantify the updated liability for each one.
- Explore settlement agreements before the worker files an amparo over the delay.
- If an amparo is filed, ensure the suspension's effects stay within the award's operative terms.
