Jalisco: choosing the wrong appeal against an administrative judgment forfeits review
Appeals in administrative litigation in the State of Jalisco. The local Administrative Court is not required to reroute, on its own motion, a reclamación appeal when the appropriate remedy against the challenged ruling is the apelación.
Official heading (Spanish): RECURSOS EN EL JUICIO CONTENCIOSO ADMINISTRATIVO EN EL ESTADO DE JALISCO. EL TRIBUNAL DE JUSTICIA ADMINISTRATIVA LOCAL NO ESTÁ OBLIGADO A REENCAUZAR OFICIOSAMENTE EL DE RECLAMACIÓN CUANDO EL PROCEDENTE CONTRA LA RESOLUCIÓN RECURRIDA ES EL DE APELACIÓN.
The ruling
A party filed a reclamación appeal against the final judgment of a single-judge chamber of the Jalisco Administrative Court. The Superior Chamber dismissed it because final judgments are appealed through the apelación under article 96 of the state law. The Collegiate Circuit Court confirmed the court need not reroute the filing on its own motion when the appellant's intent was unequivocal.
Our take
The right of access to justice does not cure a wrong remedy when the filing plainly states which appeal was intended. The court relied on the fact that the appellant named the reclamación in both the opening and the prayer for relief. One nuance we see: a more ambiguous filing might have produced a different outcome. For companies litigating state or municipal matters in Jalisco, the lesson is operational. Each state law has its own appeal system, and counting on the court to fix the label is a bet this ruling makes a losing one.
What to do
- Check the state law for the proper remedy against each type of ruling before filing.
- Make sure the opening and prayer for relief name the correct appeal and its legal basis.
- Add a state-by-state appeals table to internal litigation procedures.
