Mixed labor claims: the IMSS pension record is required even in ordinary proceedings
Procedural requirement in article 899-C, section VI, of the Federal Labor Law. It must be met even when the labor case proceeds under the ordinary procedure because mixed claims, actionable through both the ordinary and the special social security procedures, are brought.
Official heading (Spanish): REQUISITO DE PROCEDIBILIDAD PREVISTO EN EL ARTÍCULO 899-C, FRACCIÓN VI, DE LA LEY FEDERAL DEL TRABAJO. DEBE CUMPLIRSE AUN CUANDO EL JUICIO LABORAL SE TRAMITE EN EL PROCEDIMIENTO ORDINARIO, POR DEMANDARSE PRESTACIONES MIXTAS RECLAMABLES EN LAS VÍAS ORDINARIA Y ESPECIAL DE SEGURIDAD SOCIAL.
The ruling
A worker sued her employer for severance and other benefits, and IMSS for social security benefits. The case proceeded under the ordinary procedure, but the court required the pension record under article 899-C, section VI, of the Federal Labor Law and, when it was not filed, deemed the complaint not filed. The Collegiate Circuit Court held the requirement applies even when mixed claims proceed in ordinary proceedings.
Our take
Read it alongside the First Circuit ruling that dismisses only the social security claims and lets the labor claims proceed. Here the court focuses on the requirement being unavoidable and does not disturb the decision to deem the whole complaint not filed. The landscape is not uniform: depending on the circuit, a missing record may affect the entire complaint or only part of it. We do not recommend betting the defense on this; the worker can sue again with the document. It is worth checking in every mixed claim whether the requirement was met and raising the objection in time.
What to do
- In claims that include IMSS, check whether the pension record or application was filed.
- Raise the missing requirement in the answer, specifying which claims it affects.
- Maintain a merits defense on the employment claims in case the court lets them proceed anyway.
