Labor Conciliation Center fines cannot be challenged before the TFJA
Federal nullity action. It is not available against a fine imposed by the Federal Center for Labor Conciliation and Registration.
Official heading (Spanish): JUICIO CONTENCIOSO ADMINISTRATIVO FEDERAL. ES IMPROCEDENTE CONTRA UNA MULTA IMPUESTA POR EL CENTRO FEDERAL DE CONCILIACIÓN Y REGISTRO LABORAL.
The ruling
The Federal Center for Labor Conciliation and Registration fined a company for failing to attend a conciliation hearing, under article 684-E, section IV, of the Federal Labor Law. The company filed a nullity action before the TFJA, which dismissed it. The Collegiate Circuit Court agreed: the fine is labor in nature, even though an administrative body imposed it.
Our take
Choosing the wrong forum costs time and sometimes the entire defense. The ruling determines jurisdiction by the nature of the proceeding, not by the sanctioning body. It does not specify the correct route, so analyze it case by case, considering indirect amparo. The most practical approach is to avoid the fine: missing a conciliation hearing is easy to prevent. In our experience, the company should always appear through a duly empowered representative, even with no intention to settle.
What to do
- Always attend conciliation hearings through a representative with sufficient authority.
- If fined by the Center, analyze the proper challenge route before going to the TFJA.
