Pemex survivor pension: a widow need not have been named beneficiary

Post-mortem pension. The requirement conditioning its grant on the widow or common-law partner having been expressly designated as beneficiary violates the right to social security.

Official heading (Spanish): PENSIÓN POST-MORTEM. EL REQUISITO QUE CONDICIONA SU OTORGAMIENTO A QUE LA VIUDA O CONCUBINA HUBIERA SIDO DESIGNADA EXPRESAMENTE COMO BENEFICIARIA, VULNERA EL DERECHO A LA SEGURIDAD SOCIAL.

The ruling

A woman sought the lifetime survivor pension under Pemex's collective bargaining agreement after her husband, a Pemex employee, died. Pemex denied it because she had not been expressly named as beneficiary. The SCJN en banc held that article 4 of the Type 'D' Post-Mortem Pension Regulation violates the right to social security: what matters is the status of spouse or common-law partner.

Our take

The ruling arises from Pemex, but its logic reaches any pension plan or social security benefit that conditions entitlement on a formality. For the SCJN, the benefit stems from the person's status, not from a step the worker may have skipped. Companies with private pension plans or life insurance tied to collective agreements should check whether they require express designation as a condition of entitlement. If so, the clause may not survive litigation. We do distinguish between social security benefits and purely voluntary perks.

What to do

  • Review pension and insurance plans tied to collective agreements that require express designation.
  • Separate social security benefits from voluntary perks within those plans.
  • Update beneficiary payment procedures to verify spouse or common-law partner status.
