Challenge a defective labor judgment notice by motion before going to amparo

Motion to annul the notice of a labor judgment. It must be exhausted before indirect amparo under the principle of finality (interpretation of articles 762, section I, and 763 Bis of the Federal Labor Law).

Official heading (Spanish): INCIDENTE DE NULIDAD CONTRA LA NOTIFICACIÓN DE LA SENTENCIA LABORAL. DEBE AGOTARSE PREVIO AL AMPARO INDIRECTO EN OBSERVANCIA AL PRINCIPIO DE DEFINITIVIDAD (INTERPRETACIÓN DE LOS ARTÍCULOS 762, FRACCIÓN I, Y 763 BIS DE LA LEY FEDERAL DEL TRABAJO).

The ruling

Collegiate Circuit Courts disagreed on whether a motion to annul is available against the notice of a final labor judgment. The Regional Plenary Court ruled, in binding precedent (jurisprudencia), that it must be exhausted before indirect amparo under article 762, section I, of the Federal Labor Law; the time limit in article 763 Bis, before judgment, applies only to acts during the proceeding.

Our take

For companies that learn late of a labor award, this defines the first step: a motion to annul before the labor court itself, not an amparo. Skipping the motion may lead to dismissal for lack of finality, and the Plenary Court notes that its availability is no longer in doubt, so there is no excuse. The precedent binds the Central-South Region; elsewhere, check whether a different position exists. Our recommendation: although the article 763 Bis limit does not apply after judgment, file the motion as soon as the defective notice becomes known.

What to do

  • For a defective notice of a labor judgment, first file the motion to annul under article 762.
  • Document the date the company actually learned of the judgment.
  • Check whether the labor court is in the Central-South Region or another regional precedent applies.
