Missing IMSS pension record sinks social security claims, not the whole lawsuit
Partial dismissal of a labor complaint. It is warranted for social security claims when a procedural requirement is unmet, but the court must rule on the declaration of beneficiaries and on employment-related claims unconnected to them.
Official heading (Spanish): DESECHAMIENTO PARCIAL DE LA DEMANDA LABORAL. PROCEDE RESPECTO DE LAS PRESTACIONES DE SEGURIDAD SOCIAL CUANDO SE INCUMPLE ALGÚN REQUISITO DE PROCEDIBILIDAD, PERO EL TRIBUNAL DEBE PRONUNCIARSE SOBRE LA DECLARACIÓN DE BENEFICIARIOS Y LAS PRESTACIONES DERIVADAS DEL VÍNCULO LABORAL NO RELACIONADAS CON AQUÉLLAS.
The ruling
A claimant sought to be declared the beneficiary of a deceased worker, together with labor and social security benefits. Because she did not file the pension grant or denial record required by article 899-C, section VI, of the Federal Labor Law, the court dismissed the entire complaint. The Collegiate Circuit Court held that only the social security claims could be dismissed; the rest must proceed.
Our take
For employers, the ruling closes a procedural exit that was sometimes used: letting a missing IMSS document defeat claims aimed at the company. The declaration of beneficiaries and benefits arising directly from the employment relationship move forward even if the social security claims are dismissed. It is a sensible outcome. Employers should therefore provision those liabilities from the worker's death and not bet on formal defects in the complaint. In our experience, timely payment to proven beneficiaries costs less than the lawsuit.
What to do
- When a worker dies, promptly quantify outstanding employment benefits owed to the beneficiaries.
- Do not build the defense on the missing pension record when claims target the company.
- Consider settling payment once beneficiaries are identified and proven.
