No suspension to force an authority to accept a request for permanent status
Provisional suspension with restorative effects. It is not available against the physical refusal to receive a request for permanent employment status, because granting it would confer a full benefit that leaves the amparo without subject matter.
Official heading (Spanish): SUSPENSIÓN PROVISIONAL CON EFECTOS RESTITUTORIOS. ES IMPROCEDENTE CONTRA LA NEGATIVA MATERIAL A RECIBIR UNA SOLICITUD DE BASIFICACIÓN LABORAL, PORQUE SU CONCESIÓN IMPLICA UN BENEFICIO TOTAL QUE DEJA SIN MATERIA EL JUICIO DE AMPARO.
The ruling
Collegiate Circuit Courts disagreed on whether a provisional suspension with restorative effects is available against the physical refusal to accept a written request for permanent status in a public-sector position. The Regional Plenary Court held it is not: when the amparo seeks precisely the acceptance of the request, granting it would give a full, non-temporary benefit that leaves the case without subject matter.
Our take
The ruling arises in public employment, but its logic applies to any amparo: a suspension preserves the subject matter; it does not bring the judgment forward. If what is sought on the merits is identical to the interim relief, the suspension fails. For public entities that hire staff, this reduces the risk of interim orders that reshape their workforce. For petitioners, the lesson is to frame the suspension request with effects distinct from the merits. We agree, though it leaves without immediate protection someone who cannot even get a filing accepted.
What to do
- When seeking a suspension, clearly separate its effects from the amparo's main claim.
- Document any refusal to accept filings with a notary or witnesses to prove it on the merits.
- Explore alternative filing routes, such as certified mail, when the authority refuses to accept documents.
